General Conditions of Sale
Updated September 10, 2026
These General Conditions of Sale govern every auction conducted through the Moura Stock Dogs Auction website (the "Site"), which is owned and operated by Moura Stock Dogs LLC ("Moura Stock Dogs"). Moura Stock Dogs owns each dog offered for sale unless expressly stated otherwise. By completing bidder registration, accepting these Conditions of Sale, and/or placing a bid through the Site, you acknowledge that you have had the opportunity to review these Conditions of Sale and agree to be legally bound by them.
NOTICE TO ALL PARTICIPANTS
ALL PROSPECTIVE BIDDERS ARE URGED TO CAREFULLY READ THESE CONDITIONS OF SALE BEFORE PLACING ANY BID. IF YOU HAVE QUESTIONS OR CONCERNS REGARDING ANY PROVISION, YOU SHOULD CONSULT AN ATTORNEY BEFORE BIDDING.
A BID IS A LEGALLY BINDING OFFER TO PURCHASE THE DOG. DO NOT BID UNLESS YOU ARE PREPARED TO COMPLETE THE PURCHASE IF YOU ARE THE WINNING BIDDER.
WARRANTIES
ALL DOGS ARE SOLD "AS IS, WHERE IS, WITH ALL FAULTS AND DEFECTS."
MOURA STOCK DOGS MAKES NO EXPRESS OR IMPLIED WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, FUTURE PERFORMANCE, WORKING ABILITY, TRAINABILITY, TEMPERAMENT, BREEDING ABILITY, BREEDING SOUNDNESS, OR SUITABILITY FOR ANY PARTICULAR BUYER, OPERATION, LIVESTOCK, DISCIPLINE, HOUSEHOLD, OR PURPOSE.
Descriptions contained in an auction listing regarding a dog's training, experience, working ability, temperament, prior performance, or abilities describe the dog as observed or known by Moura Stock Dogs prior to the sale. Such descriptions are provided for informational purposes and do not constitute a warranty or guarantee that the dog will perform in the same manner for the Buyer.
Dogs are living animals. Their behavior, responsiveness, working ability, and performance may vary depending on the handler, environment, livestock, training methods, experience, conditioning, management, and other circumstances.
The Buyer acknowledges that Moura Stock Dogs does not guarantee the dog's future behavior, performance, working results, or suitability after the sale.
By placing a bid, the Buyer accepts the dog in its present condition based upon the information made available before the sale and subject to these Conditions of Sale.
BUYER DUE DILIGENCE AND INFORMATION PROVIDED
Moura Stock Dogs will make information regarding each dog available through the applicable auction listing, which may include photographs, videos, veterinary records or examinations, health and genetic testing, pedigree information, registry information, descriptions of training and working ability, and other information Moura Stock Dogs considers relevant to the sale.
Prospective Buyers are responsible for reviewing the information made available for each dog and determining, based on that information, whether they wish to bid.
Prospective Buyers may contact Moura Stock Dogs with questions or requests for additional information before bidding. However, Moura Stock Dogs is not obligated to provide additional photographs, videos, veterinary examinations, testing, demonstrations, or other information beyond what Moura Stock Dogs elects to make available.
In-person inspection of a dog is not a condition of the sale and is not guaranteed or required before bidding.
By placing a bid, the Buyer acknowledges that the Buyer has reviewed the information available for the dog, has had the opportunity to ask questions, and has elected to bid based on the information available at the time of the bid.
All dogs are sold AS IS in accordance with these Conditions of Sale.
GENETIC AND HEALTH TESTING
Genetic, health, DNA, and other testing results may be provided by Moura Stock Dogs or by third-party laboratories, veterinarians, registries, or other service providers.
Such testing results and third-party reports are provided as information concerning the dog and do not constitute a guarantee by Moura Stock Dogs regarding the dog's future health, condition, performance, breeding ability, or other future outcome.
Moura Stock Dogs does not independently guarantee the accuracy of testing, examinations, reports, or conclusions produced by third parties.
CATALOG INFORMATION AND ANNOUNCEMENTS
Every reasonable effort is made to ensure that information published for each dog is accurate and reflects the information known to Moura Stock Dogs at the time of publication.
Moura Stock Dogs does not assume responsibility for inadvertent typographical errors, omissions, or other catalog or website errors.
Any correction, update, disclosure, or announcement made by Moura Stock Dogs on the applicable lot page or elsewhere on the Site before bidding closes shall take precedence over previously published information concerning that lot.
Conditions of Sale
Condition No. 1 — Governing law
These Conditions of Sale and any transaction, purchase, or dispute arising out of or relating to an auction conducted through the Site shall be governed by the laws of the State of Texas, United States, without regard to principles of conflict of laws.
Condition No. 2 — Bidder registration, verification, and approval
To become eligible to bid, each prospective bidder must complete the Moura Stock Dogs bidder registration process.
Account creation and bidder registration are completed together as one process. A separate general website account is not required before registering as a bidder.
Registration requires the bidder to provide all information requested by Moura Stock Dogs, which may include:
- full legal name;
- email address;
- telephone number;
- complete address;
- login credentials;
- acceptance of applicable legal agreements; and
- a valid credit or debit card for bidder verification.
Verification card
The verification card is handled securely through a third-party payment processor and is used for bidder verification, account security, and fraud-prevention purposes.
The verification card is not used to pay for dogs purchased through the auction. Winning bidders are invoiced separately by Moura Stock Dogs after the auction closes.
Approval
Submission of a bidder registration does not automatically grant bidding privileges.
Each bidder registration is subject to review and approval by Moura Stock Dogs. A bidder may not place bids until Moura Stock Dogs has approved the registration.
Moura Stock Dogs reserves the right, in its sole discretion, to approve or reject any bidder registration, request additional information before approval, establish or adjust bidding limits, suspend bidding privileges, revoke bidding privileges, or permanently block an account from participating in future auctions.
Once approved, each bidder receives a permanent bidder number associated with that bidder's account.
The bidder number remains assigned to that account for future Moura Stock Dogs auctions and does not change from sale to sale.
The permanent bidder number is the bidder identity displayed in public bid histories.
Account Information
Each bidder is responsible for keeping the information associated with the bidder account complete, accurate, and current.
If a bidder has not logged into the Site for 60 days or more, the bidder will be required to review and confirm that the bidder's contact information, address, and verification card remain current before placing additional bids.
Moura Stock Dogs may require updated information or replacement card verification at any time if information appears outdated, incomplete, inaccurate, or invalid.
Communications and Notifications
By creating a bidder account and providing an email address and telephone number, the bidder agrees to receive account- and auction-related communications from Moura Stock Dogs by email and/or text message, as permitted by applicable law.
These communications may include, without limitation: bidder registration and approval notices; account and verification notices; auction reminders; bid confirmations; outbid notifications; auction closing notices; winning-bid notifications; invoices and payment-related communications; pickup and transportation information; and other communications relating to the bidder's account or participation in Moura Stock Dogs auctions.
Message and data rates may apply to text messages.
Condition No. 3 — Binding bids, bid increments, and proxy bidding
Every bid placed through the Site constitutes a legally binding offer to purchase the dog at the applicable amount.
Bids may not be withdrawn or retracted after they have been submitted.
Moura Stock Dogs reserves the right to refuse, cancel, invalidate, or otherwise disregard any bid where Moura Stock Dogs determines, in its sole discretion, that doing so is necessary to protect the integrity of the auction or address an error, misuse, technical problem, fraudulent activity, or other irregularity.
Each lot has a published bid increment. The minimum next bid is the current bid plus the applicable increment.
The auction server is the sole authority regarding: the current bid; the current high bidder; the sequence and timing of bids; whether a bid was received before a deadline; and the final winning bidder.
Maximum or Proxy Bidding
A bidder may enter a private maximum or proxy bid representing the highest amount the bidder is willing to pay for the lot.
The auction system will automatically bid on the bidder's behalf in the smallest increments needed to keep the bidder in the lead, up to the bidder's specified maximum.
A bidder's maximum proxy bid is confidential and is not displayed to other bidders or shown in the public bid history.
If a lot has a confidential reserve price and a bidder's maximum proxy bid meets or exceeds that reserve, the system may jump the current bid up to the reserve amount to keep that bidder in the lead.
A bidder may raise the bidder's maximum proxy bid at any time, including when the bidder is already the high bidder.
If two bidders submit identical maximum bids, the bidder whose maximum bid was received first will hold the higher bidding position.
Condition No. 4 — Soft-close / extended bidding
Lots may close at scheduled or staggered times.
If a qualifying bid is received during a lot's published extension window, the closing time for that lot will automatically be extended.
Extensions will continue until the full extension period passes without another qualifying bid.
The auction server clock controls all determinations concerning whether a bid was received before a lot closed.
Condition No. 5 — Reserve prices
Some lots may be offered subject to a confidential reserve price.
The reserve amount will not be disclosed unless Moura Stock Dogs elects to disclose it.
If bidding closes below the reserve price, the lot may be marked "Reserve Not Met," "Ended," or with similar wording, and no sale is automatically concluded.
Moura Stock Dogs may, in its sole discretion, contact one or more bidders following the auction regarding a potential private or post-sale transaction for a dog that did not meet its reserve.
Condition No. 6 — Title, risk, pickup, and delivery
Title to the dog and all risk of loss pass to the winning Buyer at the close of bidding on the applicable lot, sometimes referred to as the "fall of the gavel."
At that time, responsibility for the dog passes to the Buyer, including responsibility associated with illness, injury, or death occurring after the dog has been sold, whether or not physical delivery or pickup has yet occurred.
Delivery, release, or pickup of a purchased dog is contingent upon the Buyer making full settlement as provided in Condition No. 7.
Seven-Day Post-Sale Care and Pickup Period
A purchased dog may remain in the care of Moura Stock Dogs at no additional charge for up to seven (7) calendar days following the close of the sale to allow the Buyer time to arrange pickup or transportation.
The Buyer should communicate with Moura Stock Dogs promptly following the auction to arrange pickup, transportation, or another mutually agreed arrangement.
Any arrangement for the dog to remain with Moura Stock Dogs beyond the seven-day period must be agreed upon directly with Moura Stock Dogs.
The Buyer remains responsible for the dog during the post-sale period in accordance with these Conditions of Sale, including all risk of loss after the close of bidding.
Transportation is at the Buyer's expense and risk unless otherwise expressly agreed in writing.
Moura Stock Dogs may assist the Buyer in arranging transportation but does not guarantee or endorse any particular transporter and is not responsible for the acts or omissions of an independent transportation provider.
Upon passage of title, the Buyer agrees to indemnify and hold Moura Stock Dogs harmless from loss, cost, or expense arising from illness, injury, or death of the purchased dog after the sale; loss of or damage to property; or injury or death caused by the Buyer, the Buyer's agents, employees, representatives, transporters, or the purchased dog, except to the extent prohibited by applicable law.
Condition No. 7 — Settlement and payment
Winning bidders will be invoiced separately by Moura Stock Dogs after the auction closes.
Payment is not automatically charged to the bidder's verification card.
Unless different payment terms are expressly stated for a particular auction or lot, payment in full must be received by 5:00 p.m. Central Time on the next business day following the close of the auction.
Payment must be made in U.S. funds using an approved method stated on the invoice provided by Moura Stock Dogs.
Payment sent to any person, account, or destination other than as directed by Moura Stock Dogs on the applicable invoice is not recognized as settlement.
A payment that is returned, reversed, stopped, dishonored, or otherwise fails to clear does not constitute settlement.
The Buyer remains liable for all amounts due together with costs reasonably incurred in collecting or enforcing payment, including reasonable attorney's fees where permitted by law.
Condition No. 8 — Default
A winning bidder is responsible for completing the purchase and paying the full purchase price.
If a Buyer fails to make full settlement within the required period, the Buyer is in default.
In the event of default, Moura Stock Dogs may, in its sole discretion and without limiting any other remedy available at law or equity: (a) hold the defaulting Buyer liable for the full purchase price and reasonable costs of collection, including attorney's fees; (b) resell the dog privately or at auction and hold the defaulting Buyer liable for any deficiency between the original purchase price and the resale price, together with reasonable costs associated with the resale; (c) cancel the sale; (d) suspend or permanently revoke the Buyer's bidding privileges; (e) permanently block the bidder account from future Moura Stock Dogs auctions; and/or (f) pursue any other remedy available under applicable law.
A defaulting Buyer forfeits any right to possession of the dog unless and until Moura Stock Dogs accepts full settlement.
Any amounts previously paid may be applied against amounts owed by the Buyer to the extent permitted by law.
Condition No. 9 — Registration certificates and transfers
Where a dog is sold as registered or registrable, applicable registration certificates, transfer documents, or other registration paperwork will be processed or released only after the Buyer's payment has been received in full and has cleared.
Unless otherwise stated for the specific dog or sale, registry transfer fees are the responsibility of the Buyer.
If a registration application or certificate is pending with a registry at the time of sale, the applicable documentation will be provided or transferred once it becomes available.
Condition No. 10 — Seller identity, descriptions, and dog disclaimer
Moura Stock Dogs owns and operates the Moura Stock Dogs Auction website and is the seller of the dogs offered through the Site unless expressly stated otherwise.
Information provided in a lot description concerning a dog's training, experience, working ability, temperament, health information, pedigree, registry status, or prior performance is intended to describe the dog and the information known to Moura Stock Dogs before the sale.
Statements regarding what a dog has been trained to do, has previously done, or has demonstrated while owned, trained, or handled by Moura Stock Dogs do not constitute a guarantee that the dog will perform in the same manner for the Buyer or any other handler after the sale.
A dog described as trained, started, finished, experienced, capable of working particular livestock, or having demonstrated a particular skill is being described based upon its training and performance known to Moura Stock Dogs before the sale. Such descriptions do not guarantee identical future behavior, responsiveness, performance, or results under different ownership, handling, livestock, environments, or circumstances.
Dogs are living animals whose behavior and performance may change or vary.
Moura Stock Dogs makes no express or implied warranty regarding future working ability, future temperament, future trainability, breeding ability or breeding soundness, future health, future performance, or suitability for any particular operation, discipline, household, livestock, handler, or purpose.
Each Buyer is responsible for deciding whether to bid on and purchase a dog based upon the information made available before the sale.
ALL DOGS ARE SOLD AS IS.
Condition No. 11 — Disputes, liability, and indemnification
Any dispute relating to a purchase made through the Site is between the Buyer and Moura Stock Dogs.
To the fullest extent permitted by applicable law, the Buyer agrees to indemnify, defend, and hold harmless Moura Stock Dogs LLC and its owners, officers, employees, representatives, and agents from and against claims, demands, liabilities, damages, judgments, costs, and reasonable attorney's fees arising from or relating to: the Buyer's breach of these Conditions of Sale; the Buyer's possession, handling, transportation, ownership, or use of a purchased dog; injury or property damage caused by the Buyer or purchased dog after the sale; misuse of the Site or bidder account; or violation of applicable law by the Buyer.
Nothing in these Conditions of Sale is intended to waive any right or impose any limitation that cannot legally be waived or limited under applicable law.
Condition No. 12 — Amendments and updated terms
Moura Stock Dogs may amend these Conditions of Sale from time to time by posting a revised version on the Site.
The "Updated" date at the top of this document identifies the current version.
If these Conditions of Sale are revised after a bidder previously accepted them, Moura Stock Dogs may require the bidder to review and affirmatively accept the updated version before placing additional bids.
The Site may maintain electronic records documenting a bidder's acceptance, including the version accepted and the date and time of acceptance.
A particular auction or lot may also contain supplemental disclosures, payment requirements, pickup provisions, or other information specific to that auction or dog. Such information may supplement these Conditions of Sale but does not create a warranty or guarantee of future performance unless required by applicable law.
Condition No. 13 — International bidders
International bidders are subject to additional approval requirements.
Before an international bidder may be approved to bid, the bidder must wire funds to Moura Stock Dogs in an amount equal to the maximum total amount the bidder wishes to be permitted to spend in the auction. The wire must be received by Moura Stock Dogs in cleared U.S. funds before bidding privileges will be activated.
The amount received will establish the bidder's maximum spending limit for the auction. Moura Stock Dogs will configure the bidder's account so that the bidder cannot incur purchase obligations exceeding the amount of cleared funds received.
For example, if an international bidder wires $25,000, the bidder's maximum total purchasing limit for that auction will be $25,000.
Funds received from an international bidder will be held and applied toward any successful auction purchase made by that bidder.
If the bidder purchases one or more dogs for less than the amount wired, Moura Stock Dogs will return the remaining balance after the sale. If the bidder does not purchase any dog, the deposited funds will be returned.
All refunds will be made by bank wire to the originating account or another account approved by Moura Stock Dogs, less any bank wire, intermediary bank, correspondent bank, currency-conversion, or other banking fees incurred in receiving or returning the funds.
International bidders are responsible for initiating their wire sufficiently in advance of the auction to allow the funds to be received and cleared before bidding begins. Moura Stock Dogs is not responsible for delays caused by banks, intermediary institutions, currency conversion, international transfer procedures, or other circumstances outside its control.
Moura Stock Dogs may require additional identification, banking information, or other documentation from an international bidder before approving the bidder or returning funds.
International bidders are subject to the same pickup and post-sale care timeframes stated in these Conditions of Sale, including the seven (7) calendar day period following the close of the sale.
The international Buyer is solely responsible for arranging and completing all export-related requirements, including transportation, health certificates, veterinary examinations or treatments, vaccinations, testing, import permits, export permits, customs documentation, quarantine requirements, airline or cargo arrangements, government approvals, and any other requirements imposed by the destination country or any transit jurisdiction.
Moura Stock Dogs may, at its discretion, provide reasonable assistance or information in connection with export arrangements, but Moura Stock Dogs is not responsible for arranging, guaranteeing, or completing the export of the dog.
All export, transportation, veterinary, governmental, customs, brokerage, quarantine, and related costs are the sole responsibility of the Buyer.
Any delay in export arrangements does not extend the pickup or care period unless a separate arrangement is expressly agreed to by Moura Stock Dogs.
Condition No. 14 — Currency
All bids, purchase prices, fees, and other amounts stated on this website are in United States Dollars (USD).
